This article aplies to anyone who has a jailbroken iphone / iPod touch or want to jailbreak in the future
NOTE : to be on safe side upgrade to 3.1.2 (at the latest) and stick with it for now !
upgrading iPhone firmware to 3.1.2 is still safe and a unlock and jailbreak can be performed
upgrading to 3.1.3 is Unsafe or from what they safe if you have a jailbroken or Unlocked iPhone
Yeah from time to time they come out with new jailbreaks and new firmware but alot are saying 3.1.2 may be the last
safe firmware update
For the answer (first Question)to the Upgrade is YES & NO ! Some jailbreaks will do it for you automatically and you can alway upgrade at anytime ,but it will either lock you from rejailbreaking it or brick it if you don't unjailbreak it , but either way you can follow my previous post to fix that ! Clicky HERE
Note: A few have reported to upgrade to 3.1.1 without rejailbreaking but I just would risk the hassel !
Answer to second question : Im really not sure , But I think 3rd is still tethered only but a few claim to not have to ? Not really sure about that or not but I would do it and check personally
I dont think I would ever spring for a 3rd gen ipod touch now that iPhone Price is about the same and even if you use it just as a ipod and never put a sim card in it it has better features and works better and has a speaker that produces more sound ( Sound period if you have a first gen, meaning first gen only could use headphones )
If Verizon gets the iPhone like rumors keep saying then there will be alot more room for developement because they wont have sim cards on thse and you can flash them to Sprint & Cricket ! (can be done with any verizon phone BTW)
Cricket will do this for a charge if you sign up with them BTW

We tried a while back with my son's ipod touch and it had to be tethered so we unjailbroke it. He has a 64GB and I believe that the largest iphone is 32GB and he wanted larger. Plus I didn't want the iphone plan, my 15 yr old doesn't need a full data plan or atleast I'm not paying for that. Oh well if you hear of a for sure 3rd gen non tethering jailbreak let me know
3.1.3 has been jailbroken. It's basically the same as jailbreaking 3.1.2. Unlocking is a problem though an exploit has been re-discovered.

"On Tuesday, Apple released firmware 3.1.3 for the iPhone and iPod touches. Unless you’ve personally observed a problem with the reporting of your battery percentage, there’s no reason to update to 3.1.3. We know some of you will want to anyway. Superbowl Sunday’s PwnageTool 3.1.5 for Mac OS X will let you do so safely, preserving your jailbreak and ultrasn0w unlock. (If you use the blacksn0w unlock (at baseband 05.11.07), you need to stay at 3.1.2.)"
"iPhone 3G and 3GS unlockers should always be very wary to update their firmware. This is no exception. If you make a mistake along the way you may find yourself updating to official 3.1.3 in which case you will lose your unlock, possibly forever."
Please read the entire page multiple times before doing anything and as always if you are unsure either do nothing or ask for help first.
Also there is this tool to upgrade if you are already jailbroke or pwned.

You have to unjailbreak it before you do the upgrade don't you? Have they come up with the jailbreak for the 3rd generation that you don't have to tether to start?
